Terms of Service

1. Who we are

SEATmio (seatmio.com) is operated by Observa Systems, LLC, 131 Continental Dr, Suite 305, Newark, DE 19713, USA ("we", "us"). These terms govern the use of the SEATmio dashboard, reports, e-mails and data (the "Service") by the organisation that registers for it (the "Customer") and by the people it gives access to ("Users").

2. Accounts

Access is given to named individuals of the Customer. Credentials are personal and may not be shared. The number of Users is limited by the Customer's plan. The Customer is responsible for the activity of its Users and for keeping the list of Users current.

3. Trial

We may offer a free trial for the period stated in the invitation. The trial is free of charge and requires no payment details. It ends automatically; access then stops until the Customer subscribes. Settings, pins and reports are kept.

4. Subscription and payment

The fee is the one stated in the offer the Customer accepts, in US dollars, billed in advance for each month or year by card through our payment processor, Stripe. The subscription renews automatically for the same period until it is cancelled.

The Customer can cancel at any time on the billing page of the dashboard; cancellation takes effect at the end of the period already paid, and access continues until then. Fees already paid are not refundable, except where the law requires otherwise.

Prices do not include taxes the Customer may owe in its own country. Invoices are issued by Observa Systems, LLC and are available in the dashboard.

5. Failed payments

If a payment fails, access to the Service is suspended until the invoice is paid. When it is paid, access returns for the rest of the paid period. We keep the Customer's account and settings for at least 90 days after a subscription ends.

6. The data

SEATmio's figures are estimates derived from information cinema operators publish on their own websites and ticketing systems (seat maps, programmes, prices). They are provided "as is": we work to make them accurate and complete, but we do not guarantee either, and a figure may change when a source is re-read. SEATmio is not affiliated with the cinemas it covers.

7. Permitted use

We grant the Customer a non-exclusive, non-transferable licence to use the Service for its internal business purposes for the duration of its subscription. The Customer may quote figures in its own reports and presentations, including to its clients, citing SEATmio as the source.

The Customer may not resell or redistribute the data in bulk, make it available to third parties as a data feed, use it to build a competing product, or extract it from the dashboard by automated means.

8. Personal data

We process the Users' account details (name, e-mail, job title, sign-ins) to provide the Service, as described in our privacy notice. Card payments are processed by Stripe; we never receive or store card numbers.

9. Availability and changes to the Service

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may add, change or withdraw features and data sources; if a change materially reduces what a paid plan includes, the Customer may cancel and we will refund the unused part of the period.

10. Liability

To the fullest extent permitted by law, our total liability arising out of or in connection with the Service is limited to the fees the Customer paid in the twelve months before the claim, and we are not liable for indirect or consequential losses, including lost profits or decisions made on the basis of the data.

11. Changes to these terms

We may update these terms. We will tell the Customer by e-mail at least 30 days before a change takes effect; continuing to use the Service after that date means accepting the new version.
